Berdasarkan Pasal 8 Undang-Undang Nomor 26 Tahun 2000 tentang Pengadilan HAM, genosida adalah perbuatan yang dilakukan dengan maksud untuk menghancurkan atau memusnahkan seluruh atau sebagian kelompok bangsa, ras, suku, atau agama.

Kejahatan dilakukan secara sistematis, ditujukan langsung pada penduduk sipil. Misalnya pembunuhan, pemusnahan, perbudakan, dan lain sebagainya.

Kejahatan perang adalah tindakan pelanggaran dalam ruang lingkup hukum internasional terhadap hukum perang oleh satu atau beberapa orang, baik sipil maupun militer.

Kejahatan agresi adalah tindakan perencanaan, persiapan, dan pelaksanaan yang dilakukan oleh satu atau dua pihak, dengan tujuan untuk mengendalikan atau mengarahkan tindakan militer dan atau politik suatu negara.
