Judicial Review

Judicial review is the process by which executive and legislative acts are reviewed by the judiciary. The agency will review whether an act or law is in line with a country's constitution. The power to review itself is usually provided for by the constitution. If an action or law is deemed unconstitutional, the act or law can be repealed. Therefore, judicial review is a check and balance mechanism in the separation of powers doctrine.

Peninjauan yudisial adalah proses di mana tindakan eksekutif dan legislatif ditinjau oleh yudikatif. Badan tersebut akan meninjau apakah suatu undang-undang atau undang-undang sejalan dengan konstitusi suatu negara. Kekuasaan untuk meninjau sendiri biasanya disediakan oleh konstitusi. Jika suatu tindakan atau undang-undang dianggap inkonstitusional, tindakan atau undang-undang tersebut dapat dicabut. Oleh karena itu, judicial review merupakan mekanisme check and balance dalam doktrin pemisahan kekuasaan.
